What does an employer of record do?

An employer of record (EOR) makes it possible to hire talent in a country where your company doesn't have an entity set up. The process of setting up an entity can be time-consuming and expensive. An EOR takes away this burden by hiring employees on your behalf.

BambooHR Employer of Record powered by Remote compliantly handles the following:

  • Employee onboarding
  • Payroll and time off
  • Local employment taxes
  • Statutory and supplementary benefits
  • Contract management (employment letters, country transfer, and termination)
Is an EOR the same thing as a PEO or global payroll?

No, it is not. There are several differences between an EOR, PEO, and global payroll. While with an EOR, you do not need to own your own entity, with a PEO or global payroll you have to own your entity.

Professional Employment Organization (PEO): This is a service more common in the United States where the company and PEO "co-employ" the employee. Working with a PEO involves sharing the legal liabilities and outsourcing certain aspects of the HR functions to them.

Global payroll: This does not involve any co-employment and requires that the company have its own entity set up. The function of a global payroll is to be an outsourced payroll provider.

Where can I learn more about Employer of Record?

Admins and custom access level users with permission to manage EOR employees can visit the Global Employment tab under Settings in their BambooHR account by clicking the gear icon in the top right corner of BambooHR. From there, you can access our Global Employment Cost Calculator, which provides estimates for how much it will cost to employ through EOR (salary, benefits, and other contry-specific costs) across the world. From here, you can also request to speak with a BambooHR Global Employment Specialist who can provide a personalized demo.

What support resources do I (as an admin) and my global employee(s) have access to after we’ve signed up?

BambooHR support is available through traditional channels (email, chat, phone) to provide help. When needed, BambooHR support will also include specialists from Remote to make sure you get what you need. Additional resources include:

Can I add an existing employee to EOR?

As long as the existing employee meets the following criteria, you can add them to EOR.

  • Have an active status
  • Have no future or active Terminated status
  • Cannot already be an EOR employee

If the employee meets the criteria, navigate to their profile and, under the three-dot menu, click Hire Through Remote.

This will open a modal to select the country where the employee will be working. It will automatically populate with the country from their address on their profile (if they have one), but you can change it if needed. Click Start Contract to start the contract form for the employee.

Many of the details will pull in from their existing profile, but you can make changes as necessary.

Once the EOR employee conversion process is started, the employee record will represent the EOR contract status and BambooHR will start syncing data with Remote for the employee. Job Information, Employment Status, and Compensation: New rows will be added to the employee's record for each of these tables to reflect the new EOR details. The effective date is their Remote Provisional Start Date.

Please note, BambooHR will not update the employee's Hire Date field in BambooHR for the EOR contract.

Can I use the embedded EOR integration as well as the Remote Marketplace integration?

Yes! As long as you are a new Remote customer, you can use the embedded EOR integration alongside the Remote Marketplace integration. The embedded integration only syncs EOR employees, so using both integrations together is a great option if you also need to sync data for contractor and global payroll employees.

Key behavior differences when using both Remote integrations

How to manage EOR employees using the Marketplace integration when embedded EOR is enabled:

  1. The Marketplace integration normally requires a “Sync to Remote as” custom field for each employee.
    • For EOR employees: Do not assign any “Sync to Remote as” value. Their data is already managed by the embedded EOR integration.
    • For contractors and global payroll employees: The “Sync to Remote as” field must be set to “As contractor” or “As global payroll employee.”
  2. Do not enable “Salary and Job Title sync for Employees Hired by Remote” in the Marketplace settings when using the embedded integration. Embedded EOR handles this automatically.
  3. For time off category mapping, do not map embedded EOR-created categories within the Marketplace integration. These categories sync automatically via the embedded integration.
What is the direction of data sync for the Marketplace integration?
  1. Employee Data (Contractors + Global Payroll)
    • BambooHR > Remote
      • Note: Embedded EOR handles EOR employees separately, with real-time syncing from Remote > BambooHR.
  2. Time Off Data (Global Payroll only)
    • BambooHR > Remote
      • Note: Time off sync is not supported for contractors.
  3. Payslip Data (Global Payroll only)
    • Remote > BambooHR

The sync frequency is once per hour.

What employee data syncs for new hire contractors and global payroll employees?
  1. Email address (which serves as unique identifier for each user)
  2. First name
  3. Middle name
  4. Last name
  5. Start date
  6. Job title
  7. Country*
  8. Address (excluding country)
  9. Department
  10. Supervisor
  11. Emergency contact
  12. SSN (for US employees)

*The system will automatically assign EOR employees to a company location during the sync process once the contract is active. When the sync is run, the system will look for an exact country match among existing company locations. If an exact match is found, the employee will be assigned to that location. If no exact match is found, the system will create a new remote location using the country's name and assign the employee to that location. This sync only occurs once, and the created locations cannot be edited or deleted.

What employee data syncs for active employees once onboarding has been completed in Remote?
  1. Job title: Job title changes for EOR are synced if you configure your integration to include them (see guide here for more details)
  2. Salary (if annual salary is entered in BambooHR): Salary changes for EOR are synced if you configure your integration to include them (see guide here for more details)Department

How do I make changes to my employee’s contract after it is sent?

Admins and custom access level users with permission to manage EOR employees can request contract amendments from within the Remote platform:

  1. Access the Requests tab inside Remote
  2. Select the contract amendment option
  3. Fill out the required details and specify the effective date
  4. Submit for Remote's review and processing
What if I cancel my BambooHR account but keep Remote?

If you cancel your BambooHR account but keep your Remote account, you will be able to reach out to Remote directly for support with their platform going forward.
